Budget 2017, announced by Finance Minister (FM) Arun Jaitley on Wednesday morning, has some key points for you to note as an investor, saver and tax payer. Here are a few important announcements, from the taxpayers ‘perspective. The Total Investment & Insurance Solutions

• A big announcement was the limit of Rs3 lakh on cash transactions. This is stricter than it seemed in the Budget speech, because the limit is not only per day, but per transaction and per event. The Total Investment & Insurance Solutions

• The FM has eliminated the loophole of interest on property let out. This will now be restricted to Rs2 lakh, against other income. Additional loss allowed to be carried forward for 8 years.
• Self-employed individuals shall be eligible for deduction of up to 20% of their Gross Total Income for contribution made to National Pension System trust, within the overall limit of section 80C. The Total Investment & Insurance Solutions

• Everyone has to deduct TDS @5% if rent of more than Rs50,000 per month is paid to someone. This is expected to eliminate the practice of fake rent receipts. 

• The budget has also increased the accountability of professionals who tend to collude in tax evasion. If a chartered accountant or a merchant banker or a registered valuer furnishes incorrect information in a report or certificate, under any provisions of the Act or the rules made thereunder, he could be liable to pay Rs10,000 as penalty for each such report or certificate.

• Any delay in filing of income tax return will also attract a penalty Rs5,000 or Rs 10,000. The budget also proposes to grant interest in case of refund of excess payment of TDS.

• The budget makes it mandatory for all entities exempt from paying tax to file income tax returns. This is a much-needed clarification of what was a grey area until now. 

• The budget has plugged a big loophole of evading tax through manipulation of share prices and claiming Long term Capital Gain (LTCG) on shares. The FM has said that LTCG exemption will only be available if the securities transaction tax (STT) was paid at the time of purchasing shares. This will apply to all shares acquired after October 1, 2004 (will not include bonus shares or those acquired through initial or follow- on public offerings). 

• The tax rate for small and medium enterprises (SMEs) with a turnover of less than Rs50 crore has been reduced to 25%, which will significantly help smaller businesses. 

• The budget has also raised the requirement of a tax audit for income above Rs2 crore.

• Base for indexation in case of long term capital gain has been shifted from 01.04.1981 to 01.04.2001. The Total Investment & Insurance Solutions

• After this budget, builders will be forced to sell house within one year of receiving an occupation certificate or they may have to pay tax on notional rent. Until now, there was dispute with regard to taxability through notional rent, if the builder claimed to hold the apartments as stock in trade. The Total Investment & Insurance Solutions

• In a move aimed at curbing use of tax and anonymous donations, the FM has announced that any donation above Rs2000 in cash will not be eligible for tax deduction under Sec 80G of the income tax act. Donations have to be digital or by cheque to qualify for tax breaks. 

• The limit on cash expenses claimed by a person has been reduced from Rs20,000 to Rs10,000 per day.

• Insurance agents will be able to submit form 15G/15H for non-deduction of TDS from insurance commission. The Total Investment & Insurance Solutions

• The TDS rate for call centres has been reduced from 10% to 2%.

Foreshadowing "Buy American" moves that could affect the largest market for Indian pharmaceutical companies, US President Donald Trump told drug makers on Monday to bring back manufacturing to the United States. The Total Investment & Insurance Solutions

"I want you to manufacture in the United States," he told leaders of seven major pharmaceutical companies. "I want you to move your companies back into the United States."

To facilitate this, he said: "We're going to be lowering taxes, we're going to be getting rid of regulations that are unnecessary." The Total Investment & Insurance Solutions

India exported $6 billion worth of drugs to the US in 2015 and restrictions on pharmaceutical imports and manufacturing abroad could impact the industry in India.

Trump also hinted at the possibility of ending a multi-layered pricing system for medicines by which rates are often set lower for drugs sold abroad than in the US.

"Our trade policy will prioritise that foreign countries pay their fair share for US manufactured drugs so our drug companies have greater financial resources to accelerate the development of new cures," he said. The meeting was part of a series of meetings he has been holding with leaders of different sectors to get them to increase jobs and investment in the US to further his campaign promises. The CEOs of Amgen, Novartis and Eli Lily were among those who attended.

Trump emphasised deregulation of the strict controls on marketing medicines in the US.

"We're going to be cutting regulations at a level nobody's ever seen before," he said. "And we're going to have tremendous protection for the people, maybe more protection."

He criticised the Food and Drug Administration's (FDA) approval process for new drugs saying that he was troubled that a terminally-ill patient could not get a vital medicine because of the approval delays. The Total Investment & Insurance Solutions

An Indian American, Balaji Srinivasan, who is a technology and biotechnology entrepreneur and a critic of the functioning of the FDA, is among those being considered to head the agency.

"A lot of the companies have moved out, they don't make the drugs in our country any more," Trump said. "A lot of that has to do with regulation, a lot of it has to do with the fact that other countries take advantage of ous with their money and their money supply and devaluation."

Trump also took aim at big pharmaceutical companies over their pricing policies. "we have to get lower prices, we have to get even better innovation, he said.

For this he said that he would favour smaller companies. "I'll oppose anything that makes it harder for smaller, younger companies to take the risk of bringing their product to a vibrantly competitive market," he said. "That includes price-fixing by the biggest dog in the market, Medicare, which is what's happening. But we can increase competition and bidding wars, big time." The Budget 2017-18 was a mix of a few path-breaking moves and a sense of relief among segments of the population that it had not unleashed some new experimentation on the people. In keeping with this, the market reaction has been very positive. Finance Minister Arun Jaitley’s budget speech was more crisp and better written than his earlier ones, but steered clear of any dramatic announcements that may have fallen foul of election code or provided fodder to the opposition with several elections around the corner. He has however, made it clear that we can expect some mid-year changes as well as new legislation. The Total Investment & Insurance Solutions

Budget 2017 is significant as this was the first to integrate the Railway Budget and look at transport infrastructure in more holistic manner to include roads, aviation and shipping. The abolition of Foreign Investment Promotion Board (FIPB) is another significant announcement but since the roadmap for its abolition has still to be announced, it remains to be seen whether it survives in another avatar (like the Planning Commission morphed into Niti Aayog). The plan to merge public sector undertakings (PSUs) to create an integrated oil major is an important announcement, though it is not clear how the inefficiencies will be addressed. The Total Investment & Insurance Solutions

A Budget is not the answer to everything but the government has continuously skirted the issue of fixing accountability for the public sector has run up huge bad loans. The exchequer will dole out another Rs10,000 crore to re-capitalise loss making public sector banks (PSBs) but there is little actual action on defaulting businessmen to prevent future wilful default. The Economic Survey had talked about the “bad bank” idea, which has however, not found any favour in this year’s budget.

From Moneylife’s perspective, we were glad to see that the government has made a serious attempt to plug the menace of ramping up illiquid and closely-held listed stocks over a year and booking tax free income as long-term capital gains. This practice is rampant, as we have described in our cover story here,  and we are pleased to see that the FM made an effort to plug it. Under the new budget provisions, equity share bought on or after the 1 October 2004 would attract capital gains tax if securities transaction tax (STT) was not paid on the purchase of shares. The budget papers have clarified that bonus shares and those purchased during initial and follow on public offers, on which we pay no STT, would not attract this provision. Therefore, this provision targets those who use the preferential allotment route to acquire a large holding in illiquid scrips and exit after the stock is ramped up.

This year’s budget has ushered in a new regulator -- Payment Regulatory Board (PRB) – within Reserve Bank of India (RBI) by replacing the existing Board for Regulation and Supervision of Payment and Settlement Systems. Hopefully, this would bring parity between physical cash and digital payment transactions, along with 'interoperability' and access to a unified payment infrastructure and integrating RBI’s payment systems such as Real Time Gross Settlement System (RTGS) and National Electronic Funds Transfer (NEFT). The government is also considering the option of amending the Negotiable Instruments Act suitably to ensure that the payees of dishonoured cheques to be able to realise payments. 

There are a lot of tax incentives for the middle class and small businessmen in this Budget. The provision of holding period for immovable property for calculating long-term capital gains (LTCG) has been reduced to two years from three years. Those filing tax returns for non-business income below Rs5 lakh can do so in a single-page form. Also, there is a cut in tax rate to 5% tax rate (from 10% now) for the first slab of income. The FM has also announced that there would be no scrutiny for first time taxpayer, unless there is some high value transactions attached to him/her. 

Interestingly, although the FM pointed that while 1.2 crore cars get sold and some 2 crore people travel abroad every year, but only 76 lakhs declare income above Rs5 lakhs, he did not announce any measures to widen the tax net. The Total Investment & Insurance Solutions


All in all, most of the measures seem friendly and growth-oriented. It was much required after the violent disruption caused by demonetisation. The Sensex has given its instant verdict by jumping around 500 points.The Total Investment & Insurance Solutions

I had mentioned in Tuesday’s closing report that Nifty bulls were waiting for Budget signals. The major indices of the Indian stock markets surged on Wednesday on a positive Budget 2017 and closed with gains of over 1.75% over Tuesday’s close. NSE trading volumes were on the higher side, making it clear that the budget rally was broad-based. India Vix closed at 13.97, down 16.97%. NSE turnover was at 158.53 crore. 
Positive budgetary announcements, coupled with a strong rupee lifted the Indian equities markets during the mid-afternoon trade session on Wednesday. Union Finance Minister Arun Jaitley has presented India's national budget in the Lok Sabha on Wednesday amid hopes that the proposals will help revive a slowing economy, hit further by demonetisation of high value currency. The FM said that “the thrust in budget is stimulating growth, affordable housing, curbing black money, promoting digital economy, bringing transparency in political funding.” The Total Investment & Insurance Solutions

India said it has expressed its concern to the US over a bill to change rules on H-1B visas that will impact the IT (information technology) industry and Indian techies working in America. "India's interests and concerns have been conveyed both to the US administration and the US Congress at senior levels," said External Affairs Ministry spokesperson Vikas Swarup in New Delhi. The High-Skilled Integrity and Fairness Act of 2017, introduced in the House of Representatives by California Congressman Zoe Lofgren on Monday, calls for doubling the minimum salary of H-1B visa holders to $130,000 from the current minimum wage of $60,000 - a move that could impact Indian techies. The bill, likely to be signed by President Donald Trump, would make it difficult for firms to use the programme to replace American employees with foreign workers, including from India, with lower wages. The bill would require that employers first offer a vacant position to an equally or better qualified American worker before seeking an H1B or L-1 visa holder. It would also establish wage requirements for L-1 workers and improve H1B wage requirements to encourage companies to hire qualified American workers and prevent them from using foreign workers as a source of cheap labour. Automobile major Maruti Suzuki India on Wednesday reported a surge of 27.10% in its monthly sales for last month. According to the company, its sales during the month under review rose to 144,396 units from 113,606 units sold during the corresponding month last year. For January, the company's domestic sale was up 25.9% to 133,934 units from 106,383 units. Similarly, exports surged by 44.8% with 10,462 units shipped out, up from 7,223 units sold abroad in January 2016. Segment-wise, sales of passenger cars rose by 25.7% to 133,768 units against 106,383 units. The sales of utility vehicles have increased by a whopping 101% to 16,313 units. Trump Order Will Block 500,000 Legal US Residents From Returning to America From Trips Abroad -The Total Investment & Insurance Solutions

When details leaked earlier this week about a spate of immigration-related executive orders from President Donald Trump, much public discussion focused on a 30-day ban on new visas for citizens from seven "terror-prone" countries. The Total Investment & Insurance Solutions

But the order signed this afternoon by Trump is actually more severe, increasing the ban to 90 days. And its effects could extend well beyond preventing newcomers from Iran, Iraq, Libya, Somalia, Sudan and Yemen, from entering the U.S., lawyers consulted by ProPublica said.

Since the order's travel ban applies to all "aliens" — a term that encompasses anyone who isn't an American citizen — it could bar those with current visas or even green cards from returning to the U.S. from trips abroad, said Stephen Legomsky, a former chief counsel to the U.S. Citizenship and Immigration Services under President Obama.
"It's extraordinarily cruel," he said.

The order bans the "entry" of foreigners from those countries and specifically exempts from the ban those who hold certain diplomatic visas.

Not included in the exemption, however, are those who hold long-term temporary visas — such as students or employees — who have the right to live in the United States for years at a time, as well as to travel abroad and back as they please.

"If applied literally, this provision would bar even those visitors who had made temporary trips abroad, for example a student who went home on winter break and is now returning," Legomsky said on Friday evening executive order.
Trump made "extreme vetting" of foreigners a cornerstone of his campaign, particularly those from countries that are predominantly Muslim and that he considers hostile to the U.S.

"I'm establishing new vetting measures to keep radical Islamic terrorists out of the United States of America. We don't want them here," Trump said this afternoon, describing the intention of the executive order. "We want to ensure that we are not admitting to our country the very threats our soldiers are fighting overseas."
Trump signed the directive just before 5 p.m. but it took the White House almost three hours to release the actual text.
About 25,000 citizens from the seven countries specified in Trump's ban have been issued student or employment visas in the past three years, according to Department of Homeland Security reports. The Total Investment & Insurance Solutions

On top of that, almost 500,000 people from the seven countries have received green cards in the past decade, allowing them to live and work in the United States indefinitely. Legally speaking, green card holders are considered aliens. While lawyers are unsure if they would actually be barred from reentering the U.S. if they have traveled abroad, they conceded it's a possibility.

Abdi is concerned the temporary ban will become permanent. The order says the 90-day ban is meant to allow the U.S. and the seven targeted countries to discuss what information would need to be shared in order to start granting visas once again. US President Donald Trump is preparing to issue executive orders on the H1-B and other visas that are the life blood of Indian technology companies in the US, his spokesperson Sean Spicer has indicated raising the likelihood of stringent restrictions being placed on them. Spicer told reporters on Monday that H-1Bs and other visa are "a part of larger immigration reform effort that trump will continue to talk about through executive order and through working with Congress."

"There is an overall need to look at all these programs and you will see that both through executive action and through comprehensive legislative measures a way to address immigration as a whole and the visa programmes," he said. The Total Investment & Insurance Solutions 
Before assuming office in January, Trump said that one of his first tasks would be to issue an executive order for the Labour Department to investigate visa abuses that he asserted undercut the wages of American workers. The Total Investment & Insurance Solutions 
Along with H1-B, Spicer mentioned spousal and others as categories of visas that Trump may act on.

H1-B visas are issued to qualified professionals. A related visa is the L1, which is given to employees of a company who are transferred to the US. Both of them are used extensively by Indian companies.

Spicer said that these visas were part of the "larger immigration reform effort".

"You've already seen a lot of action on immigration," he added, referring to the temporary ban on visitors from nine countries from where this and previous administrations have perceived terrorist threats.

According to ComputerWorld magazine, nearly 86 per cent of H1-B visas for computer-related jobs and 46.5 per cent for engineering positions were given to Indians.

The US issues 85,000 H1-B visas every year, of which 20,000 are for master's degree holders from US universities. Because of the large number of applicants - 236,000 in 2016 - the H1-B visas were issued through a lottery system. The Total Investment & Insurance Solutions 
During his campaign and afterwards, Trump criticised the work visa system for the abuses in the way visas were obtained and the impact on American technology workers.

Commencing the process of crackdown on large deposits made after November 8, the Income Tax Department has identified 18 lakh taxpayers who will be served notices seeking explanation within 10 days. The Total Investment & Insurance Solutions

According to tax officials, the transactions carried out by these taxpayers post demonetisation seem out of line. The Total Investment & Insurance Solutions

The process has been labelled as "Operation Clean Money", in which data analytics has been made use of to analyse the data received between November 9 and December 30, 2016, Revenue Secretary Hasmukh Adhia told media persons at a briefing here on Tuesday. The Total Investment & Insurance Solutions

"I-T Department has initiated Operation Clean Money. Initial phase of the operation involves e-verification of large cash deposits made during November 9 to December 30, 2016. 

"Data analytics has been used for comparing the demonetisation data with information in the department's databases," the Central Board of Direct Taxes (CBDT) said in a statement.

"In the first batch, around 18 lakh persons have been identified in whose case, cash transactions do not appear to be in line with the taxpayer's profile. The I-T Department has enabled online verification of these transactions to reduce compliance cost for the taxpayers while optimising its resources," the statement said. The taxpayers covered in this phase need to submit their response on the portal within 10 days in order to avoid any further notice from the I-T Department and enforcement actions, the statement mentioned.

"E-mail and SMS will also be sent to the taxpayers for submitting online response on the e-filing portal," it said. A detailed user guide and quick reference guide is available on the portal to assist the taxpayers in submitting online response. The Total Investment & Insurance Solutions 
"Based on the taxpayers' explanation, data analytics will be used to select cases for verification. If the case is selected for verification, request for additional information and its response will also be communicated electronically," it said. The Total Investment & Insurance Solutions 
The response of taxpayer will be assessed against available information. In case explanation about the source of cash is found justified, the verification will be closed without any need to visit income tax office, it said. The Total Investment & Insurance Solutions
